Reference legislation

REGULATION

Rail, bus, sea and air passengers travelling in the EU are protected under EU legislation that recognises them a number of essential rights which are common to the four modes of collective transport. These rights are guaranteed for each mode of transport, even though the extent of coverage and the specific rules differ across the Regulations.

Passengers’ rights are recognised under the EU Regulations.

Specific rules apply to each mode of transport:

  • Regulation (EU) No 2021/782 – rail transport (applicable from 7 June 2023)
  • Regulation (EC) No 1371/2007 – rail transport
  • Regulation (EU) No 181/2011 – bus transport
  • Regulation (EU) No 1177/2010 –transport by sea and inland waterways
  • Regulation (EC) No 261/2004 – air transpor

APPLICATION OF EU REGULATIONS ON PASSENGER RIGHTS IN ITALY

The EU Regulations are the legislative source directly applicable in all Member States. Each Member State adopts the necessary measures to apply the Regulations, including sanctions in case of infringements, and designates one or more bodies in charge of their enforcement.

Pursuant to the legislative decrees implementing the EU Regulations in Italy, the Transport Regulation Authority is the body in charge of the protection of passenger rights in rail, bus, sea and inland waterway transport.

The implementing legislation is specific for each mode of transport:

  • Legislative decree no 70 of 17 April 2014 – rail transport
  • Legislative decree no 169 of 4 November 2014 – bus transport
  • Legislative decree no 129 of 29 July 2015 – sea and inland waterway transport

The Authority has approved the relevant rules of procedure for the conduct of sanctioning proceedings.

  • unified rules of procedure for the conduct of sanctioning proceeding concerning passengers’ rights in rail, bus and sea transport (effective as of 1st October 2023)
  • rules on sanctioning proceeding for infringements of the provisions of Regulation (EC) No 1371/2007 on rail passengers’ rights and obligations (continues to apply for proceedings concerning infringements of Regulation (EC) No 1371/2007 for conduct implemented before 7 June 2023);
  • rules on sanctioning proceeding for infringements of the provisions of Regulation (EU) No 181/2011 concerning the rights of passengers in bus and coach transport and amending Regulation (EC) No 2006/2004 (continues to apply for proceedings already initiated as at 1st October 2023);
  • rules on sanctioning proceeding for infringements of the provisions of Regulation (EU) No 1177/2010 of the European Parliament and of the Council concerning the rights of passengers when travelling by sea and inland waterway (continues to apply for proceedings initiated as at 1st October 2023).

Based on legislative decree no 69 of 27 January 2006, compliance with the application of the Regulation on air passengers’ rights is entrusted to the Italian Civil Aviation Authority (ENAC).

Through the Regulations, the European Union gives passengers a central place in its transport policy, and, for greater dissemination of information on passenger rights, the EU Commission has launched a dedicated information campaign.
