Access to airport infrastructure and motorway networks

In collaboration with the directorate for Access to railway and port infrastructure, this includes measures related to the mobility of passengers and freight at national, local and urban levels, including connections to stations, airports, and ports.
- In coordination with the directorate Market monitoring, regulatory model validation, data collection and processing, setting the criteria for determining tariffs, charges, and tolls related to the use of airport and motorway infrastructure, taking into account production efficiency and cost containment for users, businesses and consumers.
- With the support of the directorate for Legal Affairs and Litigation, preparing the concession schemes for the construction and/or management of motorway infrastructure, as well as tender schemes to be adopted by motorway concessionaires.
- Analysing and monitoring of the impact of acts, activities, and measures within its remit, and reporting quarterly to the Board on the outcomes of these activities.

- Collaborating with the Head of Cabinet on EU and international representation activities. Ensuring the implementation of the Authority’s policies and initiatives related to EU relations and, more broadly, international relations, including the conclusion of agreements and/or cooperation protocols necessary for these purposes.
- In collaboration with the relevant directorates, coordinating the preparation of the Authority’s contributions to represent its position before national and EU fora, as well as within EU and international networks of regulatory bodies.
- Developing the plan for the Authority’s participation in EU and international fora and coordinating the participation of Authority’s delegates in EU and international meetings and working groups.
- Coordinating activities related to bilateral and multilateral cooperation with other institutions and organisations, including drafting of texts for relevant agreements and/or cooperation protocols, as applicable.
- Managing relations with the Advisory Board.
- Handling issues related to Italy’s participation in the EU, particularly those concerning infringement procedures and EU-Pilot cases by the Commission, leveraging the support of the directorate for Legal Affairs and Litigation and the relevant directorates.
- Ensuring timely and adequate information in the event of initiatives and/or measures being adopted at the EU level that fall under the Authority’s remit, and providing prior and follow-up information on the activities performed, including for the benefit of other directorates of the Authority.
- Monitoring EU and international initiatives and legislative processes related to the sectors under the Authority’s remit, as well as the implementation of international agreements, preparing the necessary documents for participation.
- Monitoring the work schedules of major EU and international institutions in all areas of competence relevant to the Authority, and promoting and facilitating the Authority’s participation in EU and international initiatives and projects within its sectors of responsibility.
- Analysing and proposing methods for implementing regulatory practices adopted in other countries in the areas within the Authority’s remit, leveraging the expertise of the relevant directorates.
- Ensuring the translation and proof-reading of texts and documents produced by the Authority, including those intended for publication on the Authority’s official website.
Legal affairs and litigation

- Ensuring the legal quality of the Board’s decisions, assisting and supporting other directorates in addressing legal issues within their jurisdiction, and providing legal opinions on specific matters.
- Managing the Authority’s litigation procedures, including the potential exercise of powers under Article 37 (2) (n) of the decree establishing the Authority, and ensuring coordination with the State Attorney General’s Office and the District Attorney’s Offices for the management of these proceedings.
- Evaluating preliminary rulings before the Court of Justice of the European Union on matters within the Authority’s remit, in order to draft proposals for legal intervention by the Italian Government, where necessary.
- Providing legal support in the preparation of the Authority’s opinions, assisting the relevant directorates as needed.
- Identifying significant legal and regulatory issues in areas falling under the Authority’s remit.
Market functioning and regulatory impact analysis

- Reviewing the state and evolution of transport markets, including emerging markets, and analysing relevant public statistical data.

- Identifying the need for fact-finding surveys to be conducted by the Authority.
- Maintaining relations with research centres and academic institutions to inform the relevant directorates about the best international practices.

- With the support of other directorates, preparing the annual and multi-year budget, including its related amendments, budget adjustments, and financial statements.
- Ensuring accounting regularity and financial coverage for the Board’s decisions involving expenditure.
- Managing financial resources, with particular reference to revenue accounting verification, issuance of collection receipts, enforced collection, registration of commitments, accounting verification of expenditure and payment documents, management of cash services, and issuance of payment orders.
- Maintaining relations with the Board of Auditors, the Bank of Italy, and the designated credit institution, as well as communicating with the Court of Auditors, the Ministry of Economy and Finance, and other public entities.
- Ensuring the necessary procedures for the adoption of the annual decision concerning the contribution to the Authority’s operation.
- Managing relations with economic operators to ensure compliance with reporting and contribution obligations related to the operation of the Authority. With the support of other directorates, conducting both formal and substantive controls to ensure proper fulfilment of these obligations, including the recovery of any missed payments.
- When necessary, overseeing the refund procedures to economic operators regarding the contribution to the Authority’s operation.

- With respect to the different transport services and infrastructure, in consultation with other regulatory directorates, preparing the necessary measures to ensure the minimum content of rights, including compensation, that may be claimed by users from operators of transport services and infrastructure; evaluating improvements to the service charters adopted by regulated entities.
- Developing the framework for out-of-court dispute settlement between economic operators managing transport networks, infrastructure, and services, and users or consumers, and overseeing the activities related to its implementation; managing the list of ADR entities referred to in Legislative Decree No 206 of 6 September 2005.
- Promoting awareness of passenger and user rights, in collaboration with the Cabinet and the ICT and Digital Transformation directorate.

Passenger Rights

- Evaluating complaints, requests, and reports submitted by individual or associated users and consumers regarding compliance with passenger rights under EU regulations, as well as the quality and pricing levels of services provided by regulated entities. Cases requiring further follow-up will be reported to the Surveillance and Enforcement directorate, unless otherwise specified in paragraph 2.
- Carrying out preliminary activities related to passenger rights under EU regulations and relevant national sanctioning legislation, and proposing the initiation of sanctioning proceedings, when necessary. Monitoring the proper application of these regulations and overseeing the services covered by them, as outlined in the applicable provisions. Reporting quarterly to the Board on the outcomes of these activities.

ICT and digital transformation

- Ensuring the provision of ICT services, and managing systems and document flows necessary for the Authority’s activities. This includes the technical design, implementation, and management of databases and document archives, as well as their integration with external sources. Preparing technical specifications for the procurement of IT, security, and telecommunications goods and services.
- Developing policies and methodologies to ensure the security and confidentiality of the data processed by the Authority, in compliance with the relevant legal obligations, alongside the specific responsibilities assigned to certain entities under data protection legislation.
- In collaboration with the Cabinet, developing the editorial plan and informational content for the Authority’s institutional communication, managing the official website, and overseeing the Authority’s social media
- Ensuring the publication of the Authority’s decisions in accordance with the guidelines provided by the Secretary-General, and overseeing record-keeping management.
- Performing the tasks and functions referred to in Article 17 (1) of Legislative Decree No 82 of 7 March 2005, related to the transition to digital operations and the ensuing reorganisation processes aimed at achieving a digital and open administration. This includes providing easily accessible, high-quality services with enhanced efficiency and cost-effectiveness.

- in consultation with other relevant regulatory directorates, developing the minimum quality standards for national and local transport services that are subject to public service obligations, based on the territorial characteristics of supply and demand.
- with the support of the Legal affairs and Litigation directorate, preparing tender notices and related contracts for the award of transport services, as well as model agreements to be included in the tender specifications, as well as for defining model public service contracts that are directly awarded or performed by internal operators, and setting the criteria for appointing tender evaluation committees. Within these models, setting out the methods to promote financial equilibrium, efficiency, and effectiveness of services, along with ensuring accounting transparency in the compensation for public service obligations, with support from the Market monitoring, regulatory model validation, data collection and processing directorate.
- Conducting inquiries related to the application of the adopted regulatory measures concerning access to bus terminals and public transport services, with a focus on production efficiency and minimum quality standards in public service contracts.
- Carrying out the monitoring and verification activities outlined in Article 37 (2) (m) of the decree establishing the Authority.
- Ensuring coordination between the Authority’s regulation and national regulations related to local public services of economic relevance.
