By Decision 146/2023, the Transport Regulation Authority approved the unified Rules of procedure for the conduct of sanctioning proceedings falling under the remit of the Authority concerning passengers’ rights, together with the related complaint forms, that set out the rules on the conduct of sanctioning proceedings for infringements of the following provisions:
The Rules of procedure for the conduct of sanctioning proceedings falling within the remit of the Authority concerning passengers’ rights entirely replace the rules of procedure for the conduct of sanctioning proceedings adopted by the Authority’s decisions no 52/2014 of 4 July 2014, no 4/2015 of 20 January 2015 and no 86/2015 of 15 October 2015, as amended, subject to the following:
- the Rules apply to proceedings initiated after the date of their entry into force (1st October 2023), with the exception of those concerning possible infringements of Regulation (EC) No 1371/2007 for conduct pursued prior to 7th June 2023 – that may be sanctioned under Legislative Decree no 70 of 2014 in accordance with the text in force before the incorporation of the amendments made by Article 24-bis of Decree Law no 69/2023 – for which the rules on sanctioning proceedings adopted by Decision no 52/2014, as amended, continue to apply;
- for proceedings already initiated on the date of entry into force of the Rules of procedure referred to under point 1 concerning the infringements of the provisions of Regulation (EC) No 1371/2007, Regulation (EU) No 181/2011 and Regulation (EU) No 1177/2010, respectively, the rules on sanctioning proceedings for rail transport adopted by the Authority’s Decision No 52/2014 of 4 July 2014, as amended, the rules on sanctioning proceedings for bus transport adopted by the Authority’s Decision no 4/2015 of 20 January 2015, as amended, and the rules on sanctioning proceedings for sea transport adopted by the Authority’s Decision no 86/2015 of 15 October 2015, as amended, shall continue to apply.
