Additional principles and criteria regulating access to the national railway system – as per Decision No. 152/2017, as amended by Decisions No. 95/2023 and No. 130/2024

By Decision no. 152/2017 of 21 December 2017, the Transport Regulation Authority approved the additional principles and criteria regulating access to the national railway system based on the outcome of the survey referred to in Decision no. 127/2016.

By Decision no. 95/2023 of 31 May 2023, the Transport Regulation Authority repealed measures 5 through 8 of Annex A to Decision no. 152/2017 of 21 December 2017.

By Decision no. 130/2024 of 26 September 2024, in compliance with the ruling of the Council of State (Section VI) no. 1808 of 23 February  2024, the Transport Regulation Authority approved the following addition to letter a) of measure 1.1 of Annex A to Decision no. 152/2017 of 21 December 2017:

• the following is added after the words “its network development and enhancement plans”: “including the service facilities of the Infrastructure Manager,”
• the following provision is added: “For each operational phase and project as a whole, with particular reference to those co-financed by the entities referred to in Article 11 (5) of Legislative Decree no. 112/2015, the Infrastructure Manager shall provide the actual implementation timelines over the five-year period. This includes specifying the month and year of commencement or, if this information is not available, the half-year period of the working timetable in which the project/operational phase is expected to be available to capacity applicants. The Infrastructure Manager shall also ensure that any changes made to the information above is properly documented.”
