Initiation of proceeding concerning the implementation of Directive 2012/34/EU of the European Parliament and of the Council of 21 November 2012 establishing a single European railway area (recast)

The Authority initiated a penalty proceeding and challenged the IM on the infringement of the provisions governing the allocation of infrastructure capacity, as provided for by Legislative Decree No 112/2015, transposing Directive EU/2012/34 into national law.

The challenges concern the way the IM managed the requests for capacity submitted by a railway undertaking according to a procedure that does not comply with the provisions of NS 2017 and, in particular, without using the ASTRO IF communication platform (referred to in paragraph 4.2.6 of NS 2017).

The proceeding is still ongoing.
