{"id":51001,"date":"2023-05-05T16:46:31","date_gmt":"2023-05-05T14:46:31","guid":{"rendered":"https:\/\/www.autorita-trasporti.it\/?page_id=51001"},"modified":"2025-01-14T16:08:16","modified_gmt":"2025-01-14T15:08:16","slug":"art-dispute-settlement-service","status":"publish","type":"page","link":"https:\/\/www.autorita-trasporti.it\/en\/art-dispute-settlement-service\/","title":{"rendered":"ART dispute settlement service"},"content":{"rendered":"<p><em>\u201cAlternative Dispute Resolution \u2212 ADR<\/em>\u201d refers to the out-of-court procedures for dispute resolution between consumers and businesses, including dispute settlement procedures.<\/p>\n<p>By <a href=\"https:\/\/www.autorita-trasporti.it\/delibere\/delibera-n-21-2023\/\">Decision No 21\/2023<\/a>, <strong>the Transport Regulation Authority has adopted the <\/strong>\u201d <strong>Rules governing the initial implementation of out-of-court settlement of disputes between economic entities operating transport networks, infrastructure and services, and users or consumers, pursuant to <\/strong><a href=\"https:\/\/www.autorita-trasporti.it\/normativa\/art-10-legge-5-agosto-2022-n-118\/\"><strong>Article 10 of Law No 118 of 5 August 2022<\/strong><\/a>\u201d.<\/p>\n<p>These <a href=\"https:\/\/www.autorita-trasporti.it\/wp-content\/uploads\/2023\/02\/All.-A-delibera-n.-21_2023_signed.pdf\">Rules<\/a> allow \u2014 <strong>through the <a href=\"https:\/\/www.autorita-trasporti.it\/conciliaweb\/?lang=en\">ConciliaWeb<\/a> platform <\/strong><strong>\u2014<\/strong> to settle disputes concerning rail, sea and inland waterway, bus and coach, and air transport, by asserting the passengers\u2019 claims, including economic claims.<\/p>\n<hr \/>\n<h5><span style=\"color: #479dd1;\">WHEN TO REQUEST A DISPUTE SETTLEMENT TO THE AUTHORITY<br \/>\n<\/span><\/h5>\n<table style=\"width: 100%; max-width: 700px; background-color: #ededeb; height: 474px;\" width=\"700\" cellpadding=\"10\">\n<tbody>\n<tr style=\"height: 474px;\">\n<td style=\"width: 1.91667px; background-color: #479dd1; height: 474px;\"><\/td>\n<td style=\"width: 100%; max-width: 700px; height: 474px;\"><strong>Before requesting a dispute settlement, passengers must have submitted the economic operator concerned a complaint or a request for reimbursement or compensation, waiting for its response for at least 30 days<\/strong>.<\/p>\n<p>In the event of no response or unsatisfactory response from the economic operator concerned, the request for dispute settlement shall be filed within one year of the submission of the complaint or the request for reimbursement or compensation to the economic operator.<\/p>\n<p>As an alternative to ART Dispute Settlement Service, \u00a0it is always possible to address any ADR entity that complies with the requirements of the Consumer Code.<\/p>\n<p>The request for dispute settlement is in any case inadmissible if the dispute can be resolved before another Dispute Settlement Body<sup>*<\/sup>, which must comply with the requirements of the <a href=\"https:\/\/www.codicedelconsumo.it\/\" target=\"_blank\" rel=\"noopener\">Consumer Code<\/a> and must not impose charges on users.<\/p>\n<hr \/>\n<p><span style=\"font-size: 8pt;\">*<em> See\u00a0 the list of ADR entities \u00a0accredited by MISE and ODR Platform ( <a href=\"https:\/\/www.mise.gov.it\/it\/mercato-e-consumatori\/tutela-del-consumatore\/controversie-di-consumo\/adr-risoluzione-alternativa-controversie\" target=\"_blank\" rel=\"noopener\">https:\/\/www.mise.gov.it\/it\/mercato-e-consumatori\/tutela-del-consumatore\/controversie-di-consumo\/adr-risoluzione-alternativa-controversie<\/a> and <a href=\"https:\/\/www.mise.gov.it\/it\/mercato-e-consumatori\/tutela-del-consumatore\/controversie-di-consumo\/odr-risoluzione-dispute-online\" target=\"_blank\" rel=\"noopener\">https:\/\/www.mise.gov.it\/it\/mercato-e-consumatori\/tutela-del-consumatore\/controversie-di-consumo\/odr-risoluzione-dispute-online<\/a>).<\/em><\/span><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<hr \/>\n<h5><span style=\"color: #479dd1;\">HOW TO REQUEST A DISPUTE SETTLEMENT TO THE AUTHORITY<br \/>\n<\/span><\/h5>\n<table style=\"width: 100%; max-width: 700px; background-color: #ededeb;\" width=\"700\" cellpadding=\"10\">\n<tbody>\n<tr>\n<td style=\"width: 3.42857%; background-color: #479dd1;\"><\/td>\n<td style=\"width: 95.5714%;\" width=\"640\"><strong>Users who intend to request a dispute settlement shall log into the <\/strong><a href=\"https:\/\/www.autorita-trasporti.it\/conciliaweb\/?lang=en\"><strong>ConciliaWeb<\/strong><\/a> <strong>platform<\/strong><strong> via SPID (Public Digital Identity System) or eID (electronic identity card) or, only for users who are not resident in Italy, through registration<\/strong>.<\/p>\n<p>It is also possible to submit a request for dispute settlement through a delegated natural person or through an accredited entity (consumer associations, representative entities, lawyers), with appropriate delegation.<\/p>\n<p>Users, or their delegate, shall therefore <strong>\u00a0enter<\/strong> &#8211; under penalty of inadmissibility &#8211; <strong>the following data and documents<\/strong> in the platform:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>name, surname, and e-mail address;<\/li>\n<li>details of the journey made or intended to be made and copy of the ticket or reservation;<\/li>\n<li>name of the economic operator;<\/li>\n<li>the facts giving rise to the dispute and the user\u2019s claims including, where possible, their economic quantification;<\/li>\n<li>complaint, or request for reimbursement or compensation already submitted to the economic operator, as well as copy of any response received;<\/li>\n<li>any delegation, to be drawn up by using the template available in the Conciliaweb section, as well as an identity document of the delegate.<\/li>\n<\/ul>\n<p><strong>Once the request has been entered, an electronic file will be generated, with an identification number<\/strong>. From that moment, both Parties will be able to consult the file to obtain updated information on the procedure. Every time a new event occurs, an alert message will inform the parties via email.<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<hr \/>\n<h5><span style=\"color: #479dd1;\">HOW THE DISPUTE SETTLEMENT IS CONDUCTED<br \/>\n<\/span><\/h5>\n<table style=\"width: 100%; max-width: 700px; background-color: #ededeb;\" width=\"700\" cellpadding=\"10\">\n<tbody>\n<tr>\n<td style=\"width: 1.91667px; background-color: #479dd1;\"><\/td>\n<td style=\"width: 100%; max-width: 700px;\">If a cause of inadmissibility is identified, users receive a communication of dismissal or a request to supplement the missing documents, to be provided no later than 10 days (after which the request will be dismissed).<\/p>\n<p>Before the actual dispute settlement procedure is started, <strong>the parties<\/strong> <strong>may exchange through the platform <\/strong>&#8211; and without the participation of a conciliator &#8211; <strong>proposals for the settlement of the dispute (direct negotiation)<\/strong>:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>if the outcome of such negotiation is positive, the platform issues a statement of the agreement reached, signed electronically by the user and the operator concerned, and the request will be dismissed accordingly;<\/li>\n<li>on the other hand, if direct negotiation does not lead to any settlement agreement, the dispute settlement phase is initiated.<\/li>\n<\/ul>\n<p><strong>The dispute settlement <\/strong>is conducted <strong>in simplified form<\/strong>, through non-simultaneous exchange of communications between the Parties and the conciliator:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>if the dispute settlement is successful, the conciliator draws up a report &#8211; which is an enforceable instrument \u2014 whereby it takes note of the agreement concluding the dispute;<\/li>\n<li>on the other hand, if no agreement is reached at the hearing on all or some of the points at issue, the conciliator certifies in a report the negative outcome of the dispute settlement.<\/li>\n<\/ul>\n<hr \/>\n<h5><strong><span style=\"color: #479dd1;\">CONCILIATORS<\/span><\/strong><\/h5>\n<p>ART Dispute Settlement Service identifies the Conciliators within the administrative structure of the Authority or by agreement with public bodies.
